KARALISCHARTER

Terms

Terms of sale

Conditions applying to services booked through this website.

1. Subject of the contract

Karalis Charter grants exclusive use of its boat, with skipper, for the trip and date stated in the booking confirmation. The boat is not shared with other customers.

2. Booking and payment

A booking is confirmed only once the online deposit payment succeeds. The balance is paid on board before departure. The booking code sent by email is the document to show when boarding.

3. No right of withdrawal

Under art. 59(1)(n) of the Italian Consumer Code (Legislative Decree 206/2005), the fourteen-day right of withdrawal does NOT apply to contracts for leisure services to be provided on a specific date or period. Boat trips fall into this category: once confirmed, a booking is not subject to withdrawal, save as provided by the cancellation policy below.

4. Cancellation by the customer

Up to 24 hours before departure: cancellation without penalty and full refund of amounts paid. Within 24 hours of departure, and in case of no-show: no refund.

5. Cancellation for weather or safety

The decision to sail rests solely with the skipper, who assesses sea and weather conditions, forecasts and passenger safety. If a trip is cancelled for this reason, the customer chooses between an agreed new date and a full refund of amounts paid. Notice is normally given by 18:00 the day before, and in any case as soon as conditions are known. No further compensation is due: safety is not negotiable.

6. Late arrival and no-show

Boarding takes place 15 minutes before the stated time. Late arrival does not entitle the customer to extend the trip beyond the scheduled time, nor to a refund. A no-show is treated as a late cancellation.

7. Number of guests

The number of guests may not exceed the boat's licensed capacity, stated at booking. Guests beyond the declared number cannot be taken on board.

8. Conduct on board and safety

Guests follow the skipper's instructions. The crew may end the trip in case of behaviour that endangers safety, or evident intoxication, with no right to a refund. Guests under 12 wear a life jacket while under way.

9. Minors and swimming ability

Minors must be accompanied by a responsible adult, who is responsible for supervising them. Being able to swim is not required, but should be mentioned at booking.

10. Food, drinks and allergies

Food and drinks are included in the price. Allergies, intolerances and diets must be stated at booking: without that information we cannot guarantee a suitable menu and are not liable for consequent reactions.

11. Insurance and liability

The boat carries third-party and passenger accident insurance as required by law. We are not liable for personal belongings lost or damaged on board.

12. Complaints and jurisdiction

Complaints should be sent in writing to the email address indicated; we reply within 30 days. Disputes fall under the jurisdiction of the Court of Cagliari, without prejudice to mandatory consumer protection rules, which allow the consumer to sue in their place of residence. The European Online Dispute Resolution platform is also available.
